Administrative Law
Administrative law is the body of law regulating the executive branch of government and the interaction of tribunals and courts. Tribunals operate at both State and Federal level. There are two main components of administrative law. They are judicial review (concerned with the proper exercise of power) and merits review (concerned with whether the decision was correct or preferable). Our team can assist with all aspects of administrative law including review of decisions by the Queensland Building Services Authority, Workcover and Workplace Health and Safety.

Building & Construction Contracts
Our team provides advice and assistance in the negotiation, preparation and administration of tenders, contracts and sub-contracts. We have acted in many major projects including large domestic and commercial developments, multi-story unit projects, commercial and industrial developments and resorts.

Dispute Resolution
A common type of contractual dispute is when parties have conflicting interpretations over agreements and one party seeks damages from the other. It is of the utmost importance to be fully informed of your rights and legal obligations. Our team focuses on the early resolution of problems through methods such as negotiation, mediation, litigation, arbitration, expert determination and procedures under the BCIPA to obtain cost effective solutions. We have extensive experience in all jurisdictions relevant to the building industry including Magistrates, District and Supreme Courts as well as QCAT.

 | Dan Sampson | |  | Dan Sampson started at BCK in 1997 and completed his professional training in 1999. He then had a sojourn overseas from 2002 to 2004. Upon his return to BCK in 2004, Dan was appointed an Associate (2005), Senior Associate (2007) and then Partner in 2011, taking over the reins of the Building and Construction division from Paul Hick. Having practised almost exclusively in commercial litigation for over 11 years, Dan’s expertise in that area complements his knowledge of Building and Construction law and management of the firm’s Building and Construction division.

|  | Olivia Roberts | |  |
Olivia graduated from James Cook University with a Bachelor of Arts/Law in 2003. Olivia obtained a Graduate Diploma in Legal Practice from the College of Law in New South Wales in 2004 before being admitted as a solicitor in the NSW Supreme Court in February 2005. Olivia has worked in Commercial Litigation and the Building & Construction team since joining BCK in December 2006 and was appointed as an Associate in 2011.

|  | Paul Hick | |  | Paul Hick joined BCK in 2002 after a career in the Building and Construction industry and small business spanning over 20 years. This practical experience combined with Paul’s experience and qualifications as a lawyer and as a registered adjudicator with the Building and Construction Industry Payments Agency, gives Paul a particular insight into the needs of those involved in the Building and Construction industry. Paul’s client list includes mining contractors, civil, commercial and domestic builders, subcontractors, suppliers, engineers, architects and developers to name a few. His expertise is widely known and well regarded. Paul headed up BCK’s Building and Construction division from 2007 until his retirement from the partnership in 2011 when Dan took over the role. Paul is now a Senior Consultant to BCK and heads up BCK’s Fraser Coast office. He remains actively involved in supporting Dan and Olivia and maintains a number of North Queensland clients.
